Legislative Up Date 2022, Week 12, March 28th to 31st

As predicted, there is a new cannabis measure. HB2050 successfully transformed into Marijuana Licensing. This transformation is a striker/ strike all/ amendment everything. HB2050 has the same language as SB1402.

A striking amendment removes everything after the title and inserts a whole new bill. These amendments allow legislators to circumvent the deadlines on introduction of new legislation, deal with an issue that arises after the deadline, or revive a bill that previously has been defeated.

Speaking of defeated bills. It appears that SB1402 and 1715 are dead. Speaker of the House of Representatives, Rusty Bowers (R-LD) did not assign either of the measures.

It also appears the Rep Payne is going to remove his hostile amendment to SB1324

A marijuana establishment licensee is authorized to request to the Department of Health Services to become a dual licensee and be authorized to sell medical marijuana. A nonprofit medical marijuana dispensary registration certificate issued under a dual license is not counted toward the total number of nonprofit medical marijuana dispensaries authorized under any geographic requirements. A dual license cannot be split for license ownership sales or transfers. Due to voter protection, this legislation requires the affirmative vote of at least 3/4 of the members of each house of the Legislature for passage.
